Fodder Scam :

In 1996, Yadav was accused in the "Fodder Scam" in which about Rs.4.50 billion were siphoned off from the animal husbandry department, albeit the probe itself was ordered by him.

Several reports of alleged embezzlement of money withdrawn from animal husbandry department were tabled from 1990–95.

In January 1996, a raid conducted on Chaibasa treasury indicated the siphoning off of funds by non-existent companies.

Yadav then ordered an inquiry to probe the alleged irregularities.

However, after a public interest litigation, the Bihar High Court in March 1996 ordered the case to be handed over to the CBI.

In June 1997, CBI filed the charge sheet in the case and made Yadav an accused.

The fodder scam forced Yadav to resign from the office of Chief Minister and he appointed his wife, Rabri Devi, his successor as the state's Chief Minister.

In 2001, Supreme Court transferred the scam cases to newly formed Jharkhand and trial began in a special court in Ranchi in 2002.

In August 2013, Yadav tried to get the trial court judge transferred, but his plea was rejected by Supreme Court of India.

Yadav has been an accused in many of the 53-odd cases filed.

He has been remanded to custody on multiple occasions because of the number of cases.

Over 64 people were convicted in the case.

 Yadav was first sent to "Judicial remand" (Bihar Military Police guest house, Patna) on 30 July 1997, for 134 days.

On 28 October 1998, he was again sent to the same guest house for 73 days.

When the Supreme Court of India took exception to his guest house stay, he had also moved to the Beur jail in Patna.

On 26 November 2001, Yadav was again remanded, in a case related to the fodder scam.

Yadav accused the NDA of creating a conspiracy against him.

On 1 October 2004, the Supreme Court of India served a notice to Yadav and his wife, Rabri Devi, on the fodder scam.

This was in response to a petition which alleged that they have been interfering with the investigation.

Disproportionate assets :

In 1998, a disproportionate assets case was registered against Yadav and Rabri Devi.

In April 2000, both were made co-accused in the charge-sheet and surrendered.

While Rabri Devi got bail due to being CM of Bihar, Yadav was remanded for 11 days and sent to the Beur Jail.




 Due to the proceedings in the fodder scam, Yadav was remanded for a day in Beur jail on 28 November 2000.

CBI failed to prove them guilty and they were acquitted by a CBI court in 2006.

Bihar government wanted to appeal against the acquittal, but Supreme court in 2010 ruled that state government can not challenge such rulings.

In 2004, Yadav contested general election from Chhapra and Madhepura against Rajiv Pratap Rudy and Sharad Yadav respectively and won from both the seats.

In total, RJD won 21 seats and it allied with Indian National Congress becoming 2nd largest member of UPA I after Congress.

Yadav became the railway minister in the 2004 UPA Government.

Later, he gave up the Madhepura seat.

When he took over, the Indian Railways was a loss-making organization.

In the four years under his leadership, it showed a cumulative total profit of Rs.250 billion .

The turnaround of railways from a loss-making to a profit venture was actually more of a cosmetic exercise.




According to CAG, it was the new practice of issuing a "statement of cash and investible surplus" that helped Lalu project a rosy picture.

 In 2008, the profits shown were ?25,000 crore . Schools of management became interested in Yadav's leadership in managing the turnaround (with more or less the same IAS officers and the same workforce who worked under the previous ministers).

The alleged turnaround was introduced as a case study by the prestigious Indian Institute of Management.

 Yadav also received invitations from eight Ivy League schools for lectures, and addressed over a hundred students from Harvard, Wharton and others in Hindi.

Earlier in August 2008, CNN-IBN had also alleged that Yadav had misused his position as the Union Railway Minister to help his relatives acquire land.

In 2009, Yadav's successor Mamata Banerjee and the opposition parties alleged that the so-called turnaround of the Railways during his tenure was merely a result of presenting financial statements differently.

In 2011, a report by the Comptroller and Auditor General (CAG) endorsed this view.

CAG found that the "surplus" shown on the financial statements during Yadav's tenure covered "cash and investible surplus", which were not included in the "net surplus" figures released by the Railways in the earlier years.




The "cash surplus" included the money available for paying dividend, contribution to the Depreciation Reserve Fund used for renewal or replacement of existing assets, and other funds for investment.

The "investible surplus" included the money allocated for capital expenditure.

The report concluded that the performance of the Railways actually declined marginally during the last few years of Lalu's tenure.

Conviction :

Laloo Prasad Yadav, along with 44 other accused, was convicted on 30 September 2013, by Central Bureau of Investigation court at Ranchi, after being found guilty in fraudulent withdrawal of Rs.37 crores from Chaibasa treasury.

Several other politicians, IAS officers were also convicted in the case.


WONDER HOW POOR IGNORANT BIHAR PEOPLE ELECTED A BORN CRIMINAL

Immediately after the verdict was pronounced, Laloo Prasad Yadav was arrested and taken to Birsa Munda Central Jail, located at Ranchi.

Consequent upon his conviction, Mr. Yadav stands disqualified as MP and he will not be eligible to contest public election for next six years.

He has been given a jail sentence of five years and a fine of 25 lakh rupees. ( CRORES OF RUPEES SWALLOWED - WHAT A VERDICT!)

Use of Osama bin Laden's look-alike :

While campaigning for Bihar elections in 2005, both Lalu Prasad Yadav and Ram Vilas Paswan used a look-alike of Osama bin Laden to woo Muslim voters.

The look-alike would dress like bin Laden, accompany them in their helicopter to various election meetings, share the stage with them and make speeches that attacked the United States for its alleged anti-Muslim activities.

 Pramod Mahajan, senior leader of the Bharatiya Janata Party, had criticized both leaders for this by saying that they were "glorifying the name of a man who is recognized as the most wanted terrorist in the world."

Negative image :

Lalu Prasad Yadav is one of the first noted politicians to lose parliamentary seat on being arrested in fodder scam as per Supreme Court decision banning convicted legislators to hold their posts.

Despite several ongoing corruption cases against him, he and his wife Rabdi Devi ruled Bihar state for 15 years, a period during which every economic and social rankings of the state went to lowest level when compared to other states of India.

During his tenure as Chief Minister, Bihar's law and order was at lowest, kidnapping was on rise and private armies mushroomed.

Lalu's influence is mainly restricted to the Yadav and Muslim vote-banks. ( Nepotism + Communal Votes ) :

The people of Bihar have not yet forgotten the RJD's 15-year misrule during the tenures of Lalu and his wife Rabri Devi.

The law and order situation and development had become the biggest casualties during their rule.

Lalu has also been jailed several times in corruption cases including the infamous fodder scam.

He was convicted in 2013 and debarred from contesting elections.

The Patna High Court's observation made in 1997 that there was "jungle raj" in Bihar has become synonymous with the RJD rule.

The party has failed to perform satisfactorily in elections since it lost power in 2005.

It won just 22 Assembly seats in the 2010 elections in the 243-member House and four Lok Sabha seats each in the 2009 and 2014 general elections.


ANOTHER FAMILY PARTY CONGRESS LOOTING THIS NATION

As far as the Congress is concerned, it hardly has any presence in Bihar now :

It won just four seats in the 2010 Assembly elections and two seats each in the 2009 and 2014 Lok Sabha elections.

The party does not even have any prominent leader in the state.

It has been constantly on a downward slide, particularly after its defeat in the 2014 Lok Sabha elections in the backdrop of several multi-crore corruption cases and controversies. Nitish's record in governance has been overshadowed up to a large extent by his aligning with RJD and Congress.

He is constantly on the defensive over his association with Lalu and over the "jungle raj" charge.

Jungle-raj not a myth : Crime thrives under Nitish Kumar's ideal Bihar :

"Bihar is not merely India's poorest state; it is also its most corrupt, violent and lawless state," Steven R Weisman of the New York Times wrote in 1987.

Almost three decades later, little of that statement seems to have changed.

"Deeply saddened and concerned about some incidents that took place in Bihar recently. We won’t rest until all those responsible are brought to justice." This was state's Chief Minister Nitish Kumar at a function in Lucknow this May.

Nitish was referring to the recent killings in the 'lawless state' which sparked debates of resurging 'jungle-raj'. A senior journalist, bureau chief of Hindi daily Hindustan, in Siwan was shot dead in full public view in a market and a youth died over an incident of road rage in Gaya.

On Wednesday, Lok Janshakti Party (LJP) leader Sudesh Paswan was murdered in Dumaria district near Gaya. He was campaigning for Panchayat elections before he was shot dead.

According to ANI, Maoists murdered Paswan and his cousin and then set their vehicles on fire. Earlier this year, in February, another LJP leader Baijnath Singh was murdered.

In the same month, BJP's Bihar vice-president and prominent Bhojpur leader, Visheshwar Ojha was shot dead at Sonbarsa village in Ara.

The incidents resulted in Nitish's governance being heavily criticised. This was precisely why Nitish's decision to go with Lalu Prasad Yadav's RJD during the Bihar assembly election, was widely criticised.

An idea of a Bihar where one can walk around freely became the crux around which every decision of the government revolved. Just the simplicity of this notion should highlighted what had become of the state.

From 1990 to 2005 (the year when Kumar came to power in the state), the state had been more of less under the control of Lalu Prasad's Rastriya Janata Dal.

This year when Bihar became one of the only state to withstand the "Narendra Modi wave" in the country, it was largely because the JD(U)-RJD combine was riding on the back of the idea of a developed and a safe state.

An intense election campaign was used to reiterate what Kumar and his government have been saying over the span of past several years since he came to power in 2005 with Sushil Modi as his deputy chief minister. The approach to governance changed dramatically after Kumar came to power.

"I was impressed by how safe Patna had become since the National Democratic Alliance government had come to power... The Nitish Kumar-Sushil Modi jugalbandi worked superbly," wrote historian Ramchandra Guha before the 2016 elections, expressing his fears on the reversal of state's fortunes following the Kumar-Sushil Modi split and Lalu coming back to power.

But it was not just Guha's musings, the numbers too seem to supports his assertions.

India’s third-most-populous state, with the country’s poorest people — had a crime rate lower than more prosperous states with fewer people, such as Gujarat, Kerala, Rajasthan and Madhya Pradesh, an India Spend analysis of national crime data revealed.

The only problem is, this idea is difficult to back with facts, no matter not hard the chief minister and his government tries.
The numbers don't lie, bet they can be manipulated.

As the report points out, some crimes, such as rape and assault, could be hidden or not reported, but others that result in a body — such as murder or dowry deaths — are harder to hide.

In 2014, the latest year for which data are available, Bihar reported 1,77,595 cognizable crimes, while the Hindi-belt states of Madhya Pradesh (MP) and Rajasthan recorded 2,72,423 and 2,10,418 such crimes, respectively.

But Bihar’s murder rate — or murders per 1,00,000 people — is higher than either MP, Rajasthan, Gujarat or Kerala. One possible explanation is that Bihar is generally low on crime but, for some reason, is more prone to murder.

The other explanation is that crime in Bihar is under-reported — a process called burking — except for murder, where there is a body that cannot be ignored without some form of due process. Bihar’s murder rate is substantially worse than other larger states and above the national average.

A similar trend is evident with crimes against women. For instance, in 2014, Bihar reported 574 assaults on women “with intent to outrage modesty”, to use legal parlance. MP reported 9,618 such cases while Rajasthan had 6,015. Kerala, with one-third the population of Bihar, and a better place for women, reported 4,412 assaults, about eight times as many.

Does this mean Bihar is a better place for a woman, despite lower incomes and living standards? Again, the data do not suggest that.

Bihar also reports more dowry deaths than Madhya Pradesh, Rajasthan, Kerala and Gujarat combined. This statistic doesn’t appear to indicate social respect for women. One explanation is that women are indeed a target of violence, but crimes against them are not reported. However, as with general murders, a dowry death produces a body, a situation hard to hide.




As Kumar's government plans to ride a prohibition wave all the way to the 2019 general elections, things at home look bleak on a closer inspection. Cracks might be already appearing on the carefully painted image of the 'maha gathbandhan'.




Yes, the state has seen development since 2005, but past success in selected  spheres cannot be used to draw curtains over the current state of lawlessness in the state. It will only be a matter of time before people stop digesting Nitish's rhetoric of comparing crime rate in Bihar with other states ruled by BJP.
