Over half a century after the last batch of lawyers took an oath to uphold the dignity of the profession, the Bar Council of India, which regulates the legal profession in the country, has decided to bring back the oath that all fresh law graduates would have to take at the time of entering the profession.
Sources in the BCI said the new oath, which would be finalised soon, would be different from the one that was administered to lawyers who started practice in the erstwhile presidency courts (pre-Independence era) as well those in some of the oldest courts of the country post-Independence. Doctors around the world have to take the Hippocratic Oath, which is an oath historically taken by doctors, swearing to practice medicine ethically and uphold a number of professional standards.
While the Hippocratic Oath has not prevented many doctors from fleecing poor patients or indulging in irregularities, it remains to be seen what effect a similar oath would have on lawyers.
At a meeting of the executive committee of the BCI here on Sunday, members led by Solicitor General Gopal Subramanium, who is also the BCI chairperson, adorned formal robes and were administered the proposed oath.
As for the rest of the legal community, the oath would become mandatory from December onwards, the month when a new set of lawyers in expected to enter the profession following the maiden entrance exam for law graduates wishing to begin practice.
"The new oath would slightly be more modern than the older version. Anybody entering the profession would have to take the oath to uphold standards of profession," Subramanium told The Indian express.
Apart from the oath, the BCI executive on Sunday also decided to frame rules that lawyers would be expected to follow.
These rules or guidelines, to be modeled on a similar set of guidelines that lawyers in South Africa and many other countries have to follow, would be voluntary.

lawyer misconduct : as follows:
1. abuse of litigation in various ways, including using dilatory tactics and false evidence and making frivolous arguments to the courts;
2. preparation of false documentation, such as false deeds, contracts, or wills;
3.deceiving clients and other persons and misappropriating property;
4. procrastination in dealings with clients;
5. charging excessive fees;
6. Appearing for criminals and manipulate the case and allow the guilty person escape from punishment;
7. Majority advocates are happy to appear for criminals only;
8. Present day advocates in Bharatham are themselves criminal minded, and love to associate and serve for crimes and criminals;
9. Except few good lawyers who help to poors, and protect truth, put maximum effort to bring the truth of the crime in the court;
10. Others asuric lawyers live with crimes, support criminals to escape from the grips of law, such as the B A. ALOOR WHO APPEARED FOR GOVINDACHAMY, BUNTY- CHOR AND MANY MORE CRIMINALS --- SHAME TO THE PROFESSION!!!!
